These Terms of Service and Privacy Policy ("Policies") govern your use of ThinkarHouse websites, software products (including ThinkERP), and related services. They apply to customers and visitors in Bangladesh and internationally. By accessing our site, requesting a demo, starting a trial, or purchasing a subscription, you agree to these Policies.

1. Introduction & Applicability

ThinkarHouse ("we", "us", "our") is a technology company registered and operating from Dhaka, Bangladesh. We provide custom software development, consulting, and proprietary products including ThinkERP and other enterprise platforms.

These Policies apply to all users of thinkarhouse.com and related subdomains, mobile applications, SaaS portals (including poserp.thinkarhouse.com), demo environments, and any services we deliver under contract.

If you are an international customer, you acknowledge that services may be governed by the laws of Bangladesh unless a separate written agreement specifies otherwise. Where local consumer protection laws grant you mandatory rights, those rights are not waived by these Policies.

2. Terms of Service

2.1 Acceptance

By using our website or services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have authority to enter into binding agreements on behalf of yourself or your organisation.

2.2 Services

We provide professional technology services and software products as described on our website or in a signed statement of work, proposal, or subscription plan. Custom project scope, deliverables, timelines, and fees are defined in separate agreements where applicable.

2.3 Acceptable use

You agree not to misuse our services, including attempting unauthorised access, interfering with system integrity, uploading malicious code, scraping in violation of robots.txt, or using our platforms for unlawful activity. We may suspend or terminate access for violations.

2.4 Accounts & credentials

You are responsible for safeguarding login credentials for ThinkERP, demo portals, and client accounts. Notify us promptly at sales@thinkarhouse.com if you suspect unauthorised access.

2.5 Third-party services

Our products may integrate with third-party payment processors, hosting providers, analytics tools, or APIs. Your use of those services may be subject to their separate terms and privacy policies.

3. Privacy Policy

3.1 Information we collect

We may collect: (a) contact details such as name, email, phone, company, and job title; (b) account and subscription information; (c) usage data including pages visited, device type, browser, IP address, and referral source; (d) communications you send via contact forms, demo requests, careers applications, or support channels; and (e) billing-related information processed by our payment partners (we do not store full card numbers on our servers).

3.2 How we use information

We use personal data to respond to enquiries, deliver and improve our services, process subscriptions and trials, send service-related notices, analyse site performance, prevent fraud, comply with legal obligations, and—with your consent where required—share product updates or marketing communications.

3.3 Legal bases (international customers)

Where applicable under GDPR or similar laws, we process data based on contract performance, legitimate interests (such as analytics and security), legal compliance, or your consent. You may withdraw consent for marketing at any time.

3.4 Data sharing

We do not sell personal data. We may share information with trusted subprocessors (hosting, email, analytics, payment gateways) under confidentiality obligations, or when required by law, court order, or to protect our rights and users.

3.5 Data retention & security

We retain data only as long as needed for the purposes above or as required by law. We implement reasonable technical and organisational measures to protect information; however, no method of transmission over the internet is 100% secure.

3.6 Your rights

Depending on your location, you may request access, correction, deletion, restriction, or portability of your personal data, or object to certain processing. 3.7 International transfers

Data may be processed in Bangladesh and on cloud infrastructure in other countries. Where required, we take steps to ensure appropriate safeguards for cross-border transfers.

4. Cookies & Analytics

Our website uses cookies and similar technologies for essential functionality, session management, and analytics (such as understanding page visits and improving user experience). You can control cookies through your browser settings; disabling certain cookies may affect site functionality.

We may use privacy-conscious analytics on our marketing site and admin tools. Aggregated statistics do not identify individual visitors unless combined with submitted form data.

5. Subscriptions, Trials & Payments

5.1 ThinkERP & SaaS products

Subscription plans, trial periods, feature limits, and pricing for ThinkERP are described on our product pages and checkout flows. Trials convert to paid plans unless cancelled before the trial end date stated at signup.

5.2 Billing

Fees may be quoted in Bangladeshi Taka (BDT) or other currencies as displayed at purchase. International customers may be billed through approved payment gateways. Taxes, VAT, or duties may apply based on your location and are your responsibility unless stated otherwise.

5.3 Refunds & cancellation

Unless a separate agreement or plan description states otherwise, subscription fees are non-refundable for partial billing periods. You may cancel renewal according to instructions in your account portal or by contacting sales@thinkarhouse.com. Custom development projects follow the refund terms in their signed contract.

6. Intellectual Property

All content on thinkarhouse.com—including logos, text, graphics, software, and product documentation—is owned by ThinkarHouse or its licensors and protected by copyright and other intellectual property laws.

Custom work delivered under a paid project agreement becomes yours as specified in that contract. ThinkERP and other proprietary products are licensed, not sold, subject to your subscription or licence terms. You may not reverse engineer, resell, or redistribute our software except as expressly permitted.

7. Disclaimer & Limitation of Liability

Our website and services are provided "as is" and "as available" to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, ThinkarHouse shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim arising from these Policies or use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD 100 if no fees were paid, unless mandatory law requires otherwise.

8. Changes to These Policies

We may update these Policies from time to time. The "Last updated" date at the top of this page will reflect the latest revision. Material changes may be communicated via email or a notice on our website. Continued use after changes constitutes acceptance of the updated Policies.
